Jim has practiced extensively in the areas of commercial litigation and arbitration, and is resident in the firm’s Richmond office. He regularly counsels clients in the areas of financial services, commercial real estate and development, construction, distribution, technology, and professional services.
Jim has handled significant disputes involving contractual, intra-corporate and partnership issues, as well as construction claims, business torts, director and officer liability, commercial leasing, licensing, UCC and creditor’s rights issues.
He also has substantial experience in investment and financial services matters, including representing broker dealers, investment banks, investment advisors and private banks and licensed professionals in state and federal courts. He has represented clients in over 100 arbitrations, as well as numerous enforcement and regulatory proceedings.
Jim also counsels and represents clients in non-competition matters and related liability and risk management issues, including covenants not to compete, non-solicitation, non-disclosure, trade secret, “garden leave” and other agreements and restrictive covenants, “raiding” and “inevitable disclosure” claims, and common-law fiduciary issues. He regularly counsels several major employers on the acquisition of key management.
He has successfully handled disputes at every level of state and federal court in Virginia, as well as neighboring jurisdictions. He has extensive experience in arbitration and mediation before a variety of sponsoring and self-regulatory organizations.
He received his B.S in Economics from Virginia Military Institute and his J.D. from the University of Richmond School of Law. Prior to entering private practice, he served as a judicial law clerk to Justice Charles S. Russell of the Supreme Court of Virginia. Jim is an Adjunct Assistant Professor of Law at the University of Richmond School of Law, and serves on the Panel of Arbitrators for the Financial Industry Regulatory Authority (formerly NASD). He currently serves on the Executive Committee of John Marshall American Inn of Court. He has served in many leadership positions for the Bar Association of the City of Richmond, including co-chair of the Bench/Bar Conference (2002) and as former chair of the Young Lawyers Section. He is a graduate of Leadership Metro Richmond, Class of 2009, and a former Trustee of the Richmond Ballet.
